As of the 1st of April 2022, many businesses must now use fuel that’s taxed at the standard rate for DERV. The change in legislation is to increase the uptake of alternative fuels such as HVO fuel.

What is red diesel and who can use it?

Red diesel is also commonly known as gas oil, heating oil or tractor diesel and is restricted for off-road use. The name “red diesel” comes from the fuel dye that is added to the fuel in order to distinguish it from regular diesel. If you were to add red diesel to the fuel tank of your road vehicle, even long after use, the telltale signs of the red dye staining your fuel tank would alert the authorities to its past use if they were to check your fuel tank.

Only a small fraction of UK industry is legally allowed to use red diesel in vehicles and machinery as there are very strict laws in place to prohibit mainstream use. This includes:

• Rail transport
• Community amateur sports clubs and golf courses
• Sailing, boating and marine transport (excluding private pleasure craft in Northern Ireland)
• Travelling fairs and circuses
• Fuel used for non-commercial purposes – electricity generation and heating
• Agriculture, horticulture, fish farming and forestry
